DMCA / Copyright Policy

Porcelainsky LLC ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond to notices of alleged copyright infringement that comply with the DMCA and are properly submitted to our designated agent.

1. Reporting Copyright Infringement

If you believe that content on Vow to Forever (vowtoforever.com) infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or a description)
  3. Identification of the material that is claimed to be infringing and its location on the Platform (provide specific URLs)
  4. Your contact information: name, mailing address, telephone number, and email address
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. If you are unsure whether the material infringes your copyright, consider contacting an attorney before submitting a notice.

2. What Happens After a Notice

Upon receiving a valid DMCA notice, we will:

  • Promptly remove or disable access to the allegedly infringing material
  • Notify the user who posted the material that it has been removed ("takedown notification")
  • Provide the user with a copy of the DMCA notice (with the complainant's personal contact information redacted, unless legally required)

3. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA Agent. Your counter-notification must include:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal (provide specific URLs)
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the Middle District of Tennessee), and that you will accept service of process from the party who submitted the DMCA notice or their agent

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action seeking a restraining order within 10 business days, we will restore the removed material.

4. Repeat Infringers

In accordance with the DMCA, we maintain a policy of terminating the accounts of users who are repeat infringers in appropriate circumstances. If a user receives multiple valid DMCA takedown notices, we may, at our sole discretion, suspend or permanently terminate their account and remove all associated content.

5. Photo and Content Ownership

Vendors who upload photos and content to their listings represent and warrant that they own or have permission to use all uploaded material. Common sources of copyright disputes on wedding platforms include:

  • Wedding photography: Photos taken by a photographer are typically owned by the photographer, not the venue or other vendors. Vendors should only upload photos they took themselves or have a written license to use.
  • Stock images: Using stock images requires a valid license for the specific use. Free-to-download does not always mean free-to-use commercially.
  • Other vendors' work: Do not upload photos that primarily showcase another vendor's work (e.g., a florist uploading a photographer's styled image) without written permission.

6. Good Faith

We act in good faith to respond to DMCA notices and counter-notifications. We are not in a position to adjudicate copyright disputes between parties. If a dispute cannot be resolved through the DMCA process, the parties should seek resolution through the courts or alternative dispute resolution.
